JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-01-2020 This application, for grant of anticipatory bail, arises out of Tilauthu P.S. Case No. 141/2019, disclosing offences under Sections 30(a) of the Bihar Prohibition of Excise Act, 2016.

Police on information that petitioner is coming with liquor, went there and on seeing the police, petitioner after throwing the bag fled away and from the bag, 35 litres of mahua liquor was recovered.

Submission of learned counsel for the petitioner is that he has no criminal antecedent and has falsely been implicated in this case and there is no source of identification of the petitioner.

Heard learned A.P.P. also.

No.80147 of 2019(2) dt.20-01-2020 2/2 Having heard both sides, considering the facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner, however, once the petitnioer surrenders in the court below and make prayer for regular bail, the learned Special Judge will consider the submission of learned counsel for the petitioner that there is nothing to show the identification of the petitioner and will dispose of the prayer for bail of the petitioner, if possible on same day, without being prejudiced by this order.

This application is, accordingly, dismissed.
