JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-02-2019 Petitioner seeks bail in anticipation of his arrest in connection with Pupri P.S. Case No. 486 of 2018 registered for the offence punishable under Section 272, 273, 414 of the Indian Penal Code and Sections 30(a), 38, 41 of Bihar Prohibition and Excise Act.

Allegation as per FIR is of recovery of 53 and odd litres of Nepali Sufi liquor from co-accused Sunil Kumar, who disclosed the names of several persons, including the petitioner of taking liquor from the shop and further it appears that petitioner is accused in one more case of similar nature. Submission of learned counsel for the petitioner is that nothing has been recovered from his possession and furthermore in earlier case also he has been made accused on the basis of confessional statement of co-accused.

Having heard both sides and in the facts and circumstances, this application is disposed of with a direction to the petitioner to surrender within a period of six weeks from the receipt of this order and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.
