Petitioner apprehend his arrest in a case registered for the offence punishable under Section 30/30(a) of the Bihar Prohibition and Excise Act, 2016.

Informant who is a police officer in his written report has alleged that he received confidential information that Manoj Patel and Dilip Singh(petitioner) are engaged in the trade of illicit liquor and on receiving said information he raided the house of Manoj Patel and from the Gathoul of his house illicit liquor kept was recovered.

It has been submitted on behalf of the petitioner that nothing has been recovered from the conscious possession of petitioner and the illicit liquor has been recovered from the house of Manoj Patel so no offence under Excise Act is made

Patna High Court CR. MISC. No.80634 of 2019(2) dt.09-12-2019 2/2 out. He has been made accused due to animosity and village rivalry. Petitioner has got no criminal antecedent. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on anticipatory bail in the event of his/her arrest or surrender before the court below within a period of four weeks from today upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Paroo P.S. Case No. 367 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
