JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-01-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Excise Case No. 261 of 2018 for the offenses under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The petitioner is in custody since 17.11.2018. In the instant case 1382.4 liter of liquor has been recovered. He submits that the wine does not belong to the petitioner. The petitioner is not the owner of the vehicle and nothing was recovered from his conscious possession.
