The petitioner apprehends his arrest in connection with Kanti P.S. Case No. 770 of 2019 registered for the offence punishable under Sections 30(a)/38/41of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries are said to have been made from the house of the petitioner and one Rajesh Kumar Sah and the seizure-list is, but a creation of police and the recoveries have been saddled on his shoulder. There is no local/independent witness. It is further submitted that the present petitioner has no criminal antecedents.

In view of the aforementioned facts and

No.80194 of 2019(2) dt.06-12-2019 2/2 circumstances, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special judge, Excise, Muzaffarpur in connection with Kanti P.S. Case No. 770 of 2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
