The petitioner seeks pre-arrest bail in connection with Jehanabad P.S. Case No. 191 of 2018, registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The accusation is that on 09.03.2018, the informant, along with other police personnel received the information about selling of liquor at Panch Mahalla by Binod Yadav, Ramesh Yadav (petitioner), and Srikant Yadav, all sons of late Dilip Yadav, residents of village Shahwajpur, the informant, along with other police personnel reached there. On search of joint house, two plastic containers, each containing 2 liters, one plastic container, containing 1 liter and one plastic container, containing 5 liters of Indian made foreign liquor recovered.

No.82418 of 2019(4) dt.09-06-2020 2/2 Submission is that in fact, the petitioner is the student and he is residing at his native village Shahwajpur, but, being the brother of co-accused, petitioner has also been implicated in this case. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Jehanabad P.S. Case No. 191 of 2018 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge II-cum-Special Judge, Excise, Jehanabad, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
