The petitioner being the husband is in custody since 21.05.2018, in connection with Chiksaura P.S. Case No. 26/2018, registered for the offences punishable under Section 304(B) and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the entire allegation is false and there being a small child which needs the care of father, the petitioner may be extended the privilege of bail. In support of his contention, the petitioner has produced several orders, out of which one is of anticipatory bail application in the case of one Sudhir Chaudhary bearing Cr. Misc. No. 36459/2018. It also appears that in the said case, the informant had also appeared and resisted the application for
Patna High Court Cr.Misc. No.78921 of 2018(2) dt.24-01-2019 2/2 anticipatory bail. In the said submission, it has come on record that petitioner was also married previously and had killed his wife in similar manner.
Considering the above-mentioned facts and circumstances, I do not find this case to be fit, where the petitioner may be granted bail. It is accordingly, rejected. (Anjana Mishra, J) vinita/- U T
