The petitioner is accused in connection with Yadopur P.S. Case No. 101 of 2019, registered under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that in the evening of 03.10.2019, Amarjit Singh, husband of the informant, Nisha Devi, along with Phul Kumari Devi and Sita Devi had gone to field. At that time, seven persons named in the FIR including the petitioners surrounded to Amarjit Singh and started to cause assault. When Phul Kumari Devi and Sita Devi tried to save him then Anjit Singh, son of the petitioner, shot fire through pistol causing

Patna High Court CR. MISC. No.79759 of 2019(2) dt.05-12-2019 2/2 injury at the chest of her husband, Amarjit Singh, who fell down. While her husband, Amarjit Singh, was rushed to the hospital but he died in course of treatment.

Learned counsel for the petitioner submits that while petitioner is name in the FIR but no specific overt act has been attributed against him, in fact, specific allegation has been made against co-accused, Anjit Singh, to shot fire at the chest of husband of the informant but petitioner being the father of Anjit Singh, has falsely been implicated in the present case. It is further submitted that petitioner has no criminal antecedent and is in custody since 04.10.2019.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Gopalganj, in connection with Yadopur P.S. Case No. 101 of 2019. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
