JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-12-2019 The petitioners, who are persons of clean antecedents and are in jail since 14.10.2019, seek bail in connection with Muffasil P.S. Case No. 312 of 2019, dated 13.10.2019, instituted for the offences under Section 414 of the Indian Penal Code.

It has been alleged that two old motor pump sets and two old diesel pump sets were found in the vehicle which was being driven by petitioner No. 1. Petitioner No. 2 is

Patna High Court CR. MISC. No.80962 of 2019(2) dt.10-12-2019 2/2 stated to be the cleaner of the aforesaid vehicle. Learned counsel for the petitioners has submitted that no case has been reported with respect to the theft of aforesaid electric/diesel motor pumps. The petitioners were asked by the owner of the vehicle to transport the aforesaid machinery to a place at Warsaliganj in the district of Nawada.

Considering the period of custody of the petitioners, the nature of accusation against them and also taking into account their clean antecedents, they are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Muffasil P.S. Case No. 312 of 2019.

The application stands allowed.
