2. The petitioner is apprehending his arrest in connection with Akorhigola P.S.Case No.157 of 2024,FIR dated 04.07.2024 registered for the offences punishable under Sections 25(1-B),a,26 and 35 of the Arms Act.

3. The case relates to recovery of one country made rifle, two country made pistols and six live cartridges.

4. Learned counsel for the petitioner submits that the petitioner has clean antecedent and he has falsely been implicated in the present case. It appears from the FIR itself that altogether one country made rifle, two country made pistols and six live cartridges were recovered from the vehicle in question. Learned counsel for the petitioner submits that although the petitioner is owner of the vehicle in question but he has no

No.88661 of 2024(2) dt.08-01-2025 2/2 concern at all with the alleged recovery and he has also no concern at all with the arms and ammunition which was recovered from the vehicle in question and the co-accused person, namely, Nitesh Sharma @ Golu and Sanjay Kumar have been granted bail by the learned court below itself on 07.08.2024 passed in B.P.No. 415/2024 and B.P.No.414 of 2024 respectively and co-accused person, namely, Jai Prakash Kuamr has been granted privilege of anticipatory bail by the learned court below itself vide order dated 07.08.2024 passed in A.B.P.No.1415 of 2024.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail of the petitioner.

6. Considering the aforesaid facts, petitioner is owner of the vehicle in question and the recovery has been made from the vehicle in question, I am not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Akorhigola P.S.Case No.157 of 2024 pending in the court of learned S.D.J.M., Dehri, Rohtas.

7. Prayer is refused.
