2. The petitioner seeks bail in connection with Barari P.S. Case No. 397 of 2022 registered for the offence punishable under Sections 147, 148, 149, 341, 386, 302 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, Mohan Thakur and Awadhesh Yadav are the assailants of the deceased Arvind Yadav.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. There is no specific overt act against the petitioner. The petitioner is in jail since 22.07.2023.

5. Learned APP appearing for the State opposes the

Patna High Court CR. MISC. No.2961 of 2024(2) dt.24-01-2024 2/2 prayer for regular bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail, after framing of charge, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, III Katihar in connection with Barari P.S. Case No. 397 of 2022, subject to the condition that the petitioner will co-operate in the trial.
