JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2019 Petitioner apprehends her arrest in connection with Bihiaya P.S. Case No. 272 of 2018 registered for the offence punishable under Section 366A of the Indian Penal Code. Allegation against the petitioner is that she has taken away the minor daughter of the informant with her and in conspiracy with accused Tinku Kumar got the daughter of informant traceless and she has not been recovered as yet. Submission of learned counsel for the petitioner is that she is aged about 60 years and as a matter of fact there was love affair between Tinku Kumar and daughter of informant and as such she has falsely been implicated in this case. Heard learned APP also.
Having heard both sides and in the facts and circumstances and also considering the fact that petitioner is a
Patna High Court Cr.Misc. No.1527 of 2019(2) dt.23-01-2019 2/2 lady, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-V, Bhojpur at Ara, in connection with Bihiya P.S. Case No. 272 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further condition is that petitioner has to co-operate in tracing out the girl, otherwise prosecution is at liberty to move for cancellation of her bail bond.
