The petitioner is accused in connection with K. Nagar P.S. Case No. 311 of 2019, registered under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.

The accusation is that on receiving secret information about gathering of several miscreants near Kushwaha Chouck for purpose to commit offence, the informant along with other police personnel reached there and surrounded the campus of medical college, which was under construction, where eight persons named in the FIR including the petitioner were apprehended. On search, petitioner was found in

No.81386 of 2019(2) dt.16-01-2020 2/2 possession of one mobile set whereas Sarber Ali was found in possession of one country made pistol and one alive cartridge and Nishu Kumar was found from possession of one alive cartridge and others were also found in possession mobile sets. Learned counsel for the petitioner submits that petitioner has no criminal antecedent and is in custody since 15.08.2019.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea, in connection with K. Nagar P.S. Case No. 311 of 2019. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
