In this case, the petitioner is seeking anticipatory bail in connection with Kargahar P.S. Case No. 210 of 2018 registered for offence punishable under sections 30(a) and 35 of the Bihar Prohibition and Excise Act, 2016. A huge quantity of illegal liquor has been recovered from the vehicle of the petitioner.
The learned counsel for the petitioner submits that there was an agreement in between the petitioner and Umesh Kahar of hiring the vehicle in consideration amount of Rs.20,000/- but the vehicle in question is not a private vehicle. The petitioner has falsely been implicated in the present case. Looking to the facts and circumstances of the case,
Patna High Court Cr.Misc. No.78970 of 2018(4) dt.22-01-2019 2/2 this Court is not inclined to grant bail to the petitioner and accordingly his prayer for bail is rejected. However, if the petitioner surrenders and prays for regular bail, the court below without being prejudiced by this order, will take decision in accordance with law.
