The petitioner seeks bail in anticipation of his arrest in connection with Araria P.S. Case No. 796 of 2016 dated 24.11.2016 instituted for the offences under Sections 467, 468, 420, 504, 506 and 34 of the Indian Penal Code.
The prosecution case is that the informant's land was fraudulently transferred by getting a sale deed dated 07.11.1985 executed by Bibi Rehana, her mother Most. Kuresa in favour of the petitioners. On 28.08.2016 when the informant went to get her land measured, she was abused and the accused persons claimed that they have purchased the land by a sale deed.
Patna High Court Cr.Misc. No.79920 of 2018(2) dt.17-01-2019 2/2 Learned counsel appearing for the petitioner has submitted that on the basis of sale deed executed by the informant's mother and others the petitioners have come in possession of the land in question.
The petitioner is a witness in the sale deed. Considering the aforestated facts, the petitioner above named is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 796 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
