The petitioner apprehends his arrest in Excise Case No.C1-359 of 2018 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The police seized Mahindra Xylo vehicle and recovered 207 litres of Indian made foreign liquor. One Sheo Kumar was apprehended on the spot and the petitioner being driver of the said vehicle managed to flee away. Learned counsel for the petitioner submits that Sheo Kumar on the spot disclosed that the petitioner was driving the vehicle and managed to flee away.

Having considered the facts aforesaid, I am not

Patna High Court Cr.Misc. No.80118 of 2018(2) dt.15-01-2019 2/2 inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
