Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 452/326/34 of the Indian Penal Code.
The occurrence took place due to some trivial dispute arising out of some mischief done by the children while playing.
Allegation is that all the FIR named accused persons entered into the house of the informant poured kerosene
Patna High Court CR. MISC. No.82509 of 2019(7) dt.08-09-2020 2/3 oil and burnt her.
Learned counsel for the petitioner submits that the allegation is general and omnibus. All the petitioners are females and some of them are unmarried girls. They bear no specific allegation.
Learned counsel for the informant opposed the prayer for bail on the ground that some other co-accused were refused anticipatory bail by a coordinate Bench of this Court. Considering the fact that allegation is not specific against any of the petitioners and the witnesses examined by the police are not eyewitnesses of the actual occurrence, let the petitioners, above named, who are females, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Maharajganj Police Station Case No.249 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel
Patna High Court CR. MISC. No.82509 of 2019(7) dt.08-09-2020 3/3 the bail bond of the petitioners.
The petitioners shall not leave the country without permission of the trial Court.
