Counsel for the petitioner submits that this petition has been filed for commanding the respondents to make payment of the provident fund amounts which is due in the form of dearness allowances and salary deposited in the General Provident Fund of the husband of the petitioner namely, Late Durganand Jha along with the statutory interest till the date of

Patna High Court CWJC No.328 of 2025(2) dt.11-09-2025 2/3 payment for which petitioner is legally entitled.

At this state, the counsel for the petitioner submits that this case is covered by the decision rendered by the co-ordinate Bench of this Court passed in CWJC No. 11156 of 2017 and on filing of contempt in MJC No. 4927 of 2019, the respondents extended the said benefits in favour of the petitioners of that case. Similarly, various other orders have also been appended in the present petition and he prays that his case may also be directed in the same terms where the authorities would be incumbent to decide upon his case.

Be that as it may, considering the aforesaid and the issues as decided by this Court, the petitioner is directed to file a representation appending all supporting materials before the Respondent No. 4 (District Education Officer), who shall be obliged to decide the case taking cue from the ratio laid down by this Court, in similar terms which is said to have been passed by a co-ordinate Bench of this Court in CWJC No. 11156 of 2017, which the petitioner has appended with the present writ petition.

5. If the petitioner files such representation, the case of this petitioner shall be decided within a period of two months from the date of submission of such representation and

6. With the aforesaid direction / observation, the present writ petition stands disposed of.
