2. The petitioner seeks bail in a case registered for the offence punishable under section 366A of the Indian Penal Code.

3. As per the prosecution case, petitioner kidnapped 16 years old daughter of the informant for the purpose of marriage.

4. Learned counsel appearing for the petitioner submits that the victim in her 164 Cr.P.C. statement has denied the prosecution case. She has stated that she was in love with the petitioner since long and she on her own sweet will left the house and now she has solemnized marriage with him. Her age has been assessed as 19 years. Petitioner claims clean antecedent. Petitioner is in custody since 25.8.2023.

5. Considering the victim's 164 Cr.P.C. statement, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in Rajgir Police Station Case No. 428 of 2023.
