JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-02-2019 Petitioner seeks bail in anticipation of his arrest in connection with G.O. Case No. 36 of 2018, arising out of Bahadurpur P.S. Case No. 14 of 2018 registered for the offences punishable under Sections 30(a), 34, 36, 38 and 41 of the Bihar Prohibition and Excise Act.

Allegation is of recovery of 90 litres of liquor from the husk house of the petitioner.

Submission of learned counsel for the petitioner is that the husk house is situated outside the house and there is no door in the husk house and possibility of keeping the same in the husk house by anyone cannot be ruled out. Heard learned APP also.

Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest

Patna High Court Cr.Misc. No.80544 of 2018(3) dt.14-02-2019 2/2 or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-IV-cum-Special Judge, Darbhanga, in connection with G.O. Case No. 36 of 2018, arising out of Bahadurpur P.S. Case No. 14 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
