The petitioner seeks bail in connection with Maheshkhunt P.S. Case No.240 of 2022 registered for the offence under Sections 392, 364, 379/34 of the Indian Penal Code.

The allegation against the petitioner is to have taken away e-rickshaw, cash of Rs. 450/- and mobile of the informant by pointing the pistol on the temple of the informant. 4.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner has falsely been implicated in the present case. It is submitted that name of the petitioner surfaced, during course of investigation, on the basis of confessional statement of the other co-accused person. It is

No.6149 of 2024(2) dt.16-02-2024 2/2 submitted that nothing incriminating article has been recovered from the possession of this petitioner, which may connect this petitioner with the present set of occurrence. It is also submitted that after investigation charge-sheet has been submitted by the I/O only under Section 392 of the IPC. It is further submitted that similarly situated co-accused person has already been granted bail by one of the learned co-ordinate Bench of this Court through Cr. Misc. No. 71692 of 2023 on 06.02.2024. It is further submitted that the petitioner is in custody since 16.08.2023.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances and submissions made on behalf of the petitioner, let the petitioner, above named, is directed to be released on bail in connection with Maheshkhunt P.S. Case No.240 of 2022 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate - Ist Class, Khagaria.
