JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-03-2019 The petitioner apprehends his arrest in connection with Gopalpur P.S.Case No. 198 of 2014 registered under Sections 379, 494 and 498A of the Indian penal Code. Allegation against the petitioner is of subjecting the informant with respect to demand of dowry to cruelty and harassment and also remarried by another lady. Submission of learned counsel for the petitioner is that earlier also a case has been lodged by the informant in which he has been granted bail and now present case has been lodged and he is ready to keep her.

Heard learned APP also and learned counsel appearing on behalf of the informant who have opposed the prayer for bail and submitted that she has daughters also and petitioner is not

Having heard both sides and in the facts and circumstances, as stated above, this application is disposed of with a direction to the petitioner to surrender before the court below within a period of six weeks from the date of receipt of a copy of this order and on his surrender he will be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Naugachia in connection with Gopalpur P.S. Case No. 198 of 2014; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that he will have to pay Rs. 2,500/- per month to the informant for her maintenance and also her daughter till the matter is decided or any interim order is passed in maintenance case, if any, filed by the informant. If petitioner fails to pay the maintenance amount, O.P. No. 2 will have liberty to move before the court below for cancellation of his bail bond.
