The petitioner seeks bail in connection with Gopalpur P.S. Case No. 268 of 2019, registered under Sections 25(1-b)(a) and 26 of the Arms Act and 30(a) and 37(b)(c) of the Bihar Prohibition and Excise Act, 2016.

The accusation is that in course of patrolling duty, the petitioner was apprehended in suspicious condition. On search, he was found in possession of a loaded country made pistol, along with one live and two miss-fired cartridges and with bag containing 17 pouches, each containing 400 ml country made liquor.

Submission is that petitioner has no criminal antecedent and he is in custody since 09.09.2019. Having regard to the facts and circumstances of the
