Mr.Sri Anil Kumar Singh 1 ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-01-2019 Heard the learned counsel for the petitioners and the learned counsel for the State.

The petitioners seek regular bail in connection with Piyar (Hatha O.P.) PS case no. 155 of 2018 registered for the offence punishable under Section 414/34 of Indian Penal Code.

The allegation is regarding recovery of one motorcycle from the petitioners and upon them having made disclosure, another motorcycle was recovered from the house of Arjun Ram.

The learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case and are having clean antecedent, however the petitioners

Patna High Court Cr.Misc. No.80220 of 2018(2) dt.25-01-2019 2/2 are ready to deposit Rs. 50,000/- by way of cash security for the purpose of grant of regular bail. The petitioners are said to be languishing in custody since 01.09.2018.

Having regard to the facts and circumstances of the case, I direct for release of the petitioners on regular bail subject to deposit of a sum of Rs. 50,000/- before the learned trial court, which shall be kept in a fixed deposit, and upon such other conditions which may be imposed by the learned court of Judicial Magistrate 1st class, Muzaffarpur in connection with Piyar (Hatha O.P.) PS case no. 155 of 2018.

The present petition stands disposed of with the aforesaid directions.
