JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-02-2020 Petitioner seeks bail in connection with Turkaulia (Banjaria) P.S. Case No. 340 of 2019, registered for the offence punishable under Sections 302/34 of the Indian Penal Code. As per FIR, petitioner happens to be husband of the deceased and allegation is that he strangulated his wife, causing her death.

Submission of learned counsel for the petitioner is that post mortem report does not support the prosecution case and cause of death is showing haemorrhage due to hard and blunt substance and he is in custody since 11.6.2019. Heard learned APP, who has opposed the prayer for bail stating that there are some injuries found on the person of

Patna High Court CR. MISC. No.84447 of 2019(3) dt.18-02-2020 2/2 deceased and cause of death is haemorrhage and further submission is that some of the witnesses have also supported the prosecution case.

In view of above facts and circumstances, I am not inclined to grant bail to the petitioner at this stage. However, once charge has been framed in this case, petitioner is at liberty to renew his prayer for bail.

Accordingly, this application is dismissed.
