JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 15-01-2019 Heard learned counsel for the petitioners and learned learned Additional Public Prosecutor for the State. The petitioners are in custody in connection with Baikunthpur P.S. Case No. 258 of 2018 for the offenses under Sections 30(a), 41, 32(b) ii, 38(I) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioners submits that petitioners have no criminal antecedent. Referring to the prosecution case he submits that in the instant case five persons have been named as accused. The petitioner was not named in the FIR. His name surfaced subsequently on the basis of confessional statement of co-accused Bipul Kumar. The petitioner is in custody since 3.12.2018.

No.80497 of 2018(2) dt.15-01-2019 2/2 Considering the aforesaid, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the A.D.J-II-cum- Special Judge, Excise, Gopalganj in connection with Baikunthpur P.S. Case No. 258 of 2018.
