2. The petitioner seeks bail in connection with Phulwariya P.S. Case No. 274 of 2024 instituted for the offences under Section 140(2) of the Bharatiya Nyaya Sanhita, 2023.

3. Accusation against the unknown miscreant is of kidnapping the minor son of the informant as also demanded Rs. 10,00,000/- as ransom.

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Petitioner is not named in the F.I.R. The name of the petitioner transpired in this case during investigation. There is no eyewitness to the alleged occurrence. Learned counsel further

Patna High Court CR. MISC. No.742 of 2025(3) dt.03-04-2025 2/3 submitted that none of the mobile numbers from which the ransom was demanded belongs to the petitioner. Learned counsel further submitted that T.I.P. has not been conducted till date. It has been submitted on behalf of the petitioner that the petitioner is in custody since 29.09.2024 and has no criminal antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. Learned APP further submitted that as per the material available in the case diary, the petitioner was apprehended with the victim and also as per the statement of the victim recorded under Section 164 of the Cr.P.C. (Section 183 BNSS), this petitioner is involved in the kidnapping of the minor son of the informant and demanding ransom. Learned APP, therefore, submits that there is ample material against the petitioner to prove his involvement in the alleged occurrence and therefore, learned APP prays that he may not be released on bail.

6. Considering the aforesaid facts and circumstances of the case as also there being ample material against the petitioner available in the case diary, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, the prayer for grant of bail to the
