JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-02-2019 This application, for grant of anticipatory bail, arises out of Mahua P.S. Case No. 134/18, disclosing offences under Sections 3/4 of the Dowry Prohibition Act.
Allegation is that marriage of petitioner no. 1 was fixed with the daughter of the informant, who said to have taken Rs. Five lakhs as dowry. Petitioner nos. 2 and 3 are the brothers of petitioner no. 1.
Submission of learned counsel for the petitioners is that out and out false and fabricated allegation has been levelled and it is very unusual that the money was given to the bridegroom rather generally the negotiation is done between the parents and not by the bridegroom. Moreover, no money was given by the informant to any of the petitioners and no Faldan

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali, in connection with Mahua P.S.
