This is an application for grant of regular bail filed on behalf of the petitioner. Petitioner is in custody in connection with Mirganj PS Case No. 324 of 2018 for the alleged offence punishable under Section 30(A) of the Bihar Prohibition and Excise Act, 2016 and Sections 272 and 273 of the Indian Penal Code.

In the instant case, total 16 liters of country made liquor was seized. Learned counsel appearing for the petitioner submits that petitioner has no criminal antecedent. He further submits that one Amit Kumar Gupta who was arrested on the spot has disclosed the name of the petitioner. He submits that petitioner is in custody since 28.11.2018.

Patna High Court Cr.Misc. No.80303 of 2018(2) dt.28-01-2019 2/2 Considering the fact that petitioner has no criminal antecedent and he is in custody since 28.11.2018, this application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Addl. Sessions Judge-cum-Special Judge, Gopalganj in connection with Mirganj PS Case No. 324 of 2018.
