The petitioner apprehend their arrest in connection with Muzaffarpur Sadar P.S. Case no. 832 of 2018, registered under Section 302/34 of the Indian Penal Code. The accusation is that the marriage of the sister of the informant Radhe Shyam Yadav was performed with Rajesh Kumar Yadav, who used to reside presently at Nandpuri, Bhagwanpur, P.S.Sadar, District-Muzaffarpur and due to the wedlock, his sister was blessed with one daughter Saneha, aged about 12 years and one son Aryans, aged about 10 years. Since, 3 to 4 years, Rajesh Kumar Yadav kept to Kittu as concubine,
Patna High Court CR. MISC. No.79316 of 2018(3) dt.02-05-2019 2/3 then his sister made protest on which she was being harassed by her husband, Hina and mother of Hina. On 29.10.2018, Rajesh Kumar Yadav along with Hina and his mother came at the residence of his sister and committed her murder by pressing her neck.
Learned counsel for the petitioners submits that the petitioners have no relation with the Rajesh Kumar Yadav, brother-in-law of the informant and mere on suspicion both the petitioners have falsely been implicated in this case with allegation that petitioner No.1 Hina Warsi is concubine of Rajesh Kumar Yadav and petitioner No.2 is the mother of Hina and both helped to co-accused Rajesh Yadav in pressing the Rakhika, sister of informant. Further submission is that Saneha Kumari and Aryan, daughter and son of the sister of the informant have stated in paragraph-5 and 6 regarding quarrel between their mother and Rajesh Kumar Yadav, but they have not stated about presence of petitioners at the place of occurrence.
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail
Patna High Court CR. MISC. No.79316 of 2018(3) dt.02-05-2019 3/3 bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Sadar P.S. Case No. 832 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
