Instead of filtering the allegation followed with submission made on behalf of rival parties, it looks sufficient to incorporate that neither from the allegation nor from the case diary, a case under Section 406 IPC is made out. Now remains Section 506 IPC which is bailable one and that being so, petitioner is well advised to surrender before the learned lower court and pray for bail which the learned lower court will appreciate in the background of observation made hereinabove. In terms thereof, instant petition for anticipatory bail stands disposed of.
