2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 25(1-b)a, 26 and 35 of the Arms Act.

3. The case of the prosecution is that the informant has gone to post-office to deposit Rs. 50,000/- and after filling the deposit form, he was standing in the queue near the counter with his bag. It is alleged that the petitioner put his hand inside the bag of the informant and tried to take out the money. He was caught with the help of people there and on inquiry, the petitioner was identified and from his possession, one country made pistol along with three live cartridges was recovered.

4. Learned counsel for the petitioner submits that the

Learned counsel for the petitioner has submitted that in this case, the petitioner has been apprehended by the informant himself. He has not apprehended by police. It has been submitted that it is merely a case of attempt of theft which could not be completed. Nothing has been stolen. Moreover, the petitioner is languishing in judicial custody since 03.06.2025.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail and submitted that petitioner has been caught red handed while trying to commit theft. He is also having criminal antecedent of two cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Lalmatiya P.S. Case No. 67 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magisrate 1st Class, Bhagalpur.
