2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 126(2), 127(2), 15(2), 118
(1) , 76, 109, 352, 351 ( 2 ), 3(5) of BNS and Section 27 of Arms Act.
3 . As per the prosecution case , this petitioner along with other co-accused persons came on 8 to 9 motorcycles and abused the informant and family members and tore her apparel and one of the accused persons opened fire but did not hit anyone .
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case . Nothing has been recovered from the conscious
Patna High Court CR. MISC. No.89026 of 2024(2) dt.20-01-2025 2/2 possession of the petitioner. Allegation is general and omnibus. No specific overt act has been alleged against this petitioner. 5 . Learned counsel for the State opposed the prayer for bail and submitted that petitioner is named in the F.I.R., with specific allegation that he along with other co-accused persons came on 8 to 9 motorcycles and abused the informant and her family members and tore her apparel and also fired upon them. Petitioner has got 8 criminal antecedents.
6. Considering the nature of accusation and criminal antecedents of the petitioner and other circumstances of the case , prayer for pre-arrest bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Koushik/- U T
