JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 15-01-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Ander P.S. Case No. 224 of 2018 for the offence under Sections 272, 273, 290, 308 of the Indian Penal Code and Sections 30(a), 36 and 41(i) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner is in custody since 05.11.2018 in connection with seizure of 1.080 litres of liquor.

Notwithstanding the fact that in past such allegation has been levelled against the petitioner, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum-Special Judge, Excise, Siwan in connection with

Patna High Court Cr.Misc. No.80507 of 2018(2) dt.15-01-2019 2/2 Ander P.S. Case No. 224 of 2018.

In the event, the name of the petitioner surfaces in similar case, in future, the court below shall be at liberty to cancel the bail bonds of the petitioner.
