====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 13-12-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Petitioner in the present case is seeking anticipatory bail in connection with Jadiya P.S. Case No. 136 of 2019 registered for the offences punishable under Sections 341, 323, 354, 379, 504, 506 of the Indian Penal Code.

Learned counsel for the petitioner submits that the instant case is totally false and concocted and has been lodged with oblique motive and to save her skin. It is further submitted that no injury report has been brought on record which shows that the present case lodged by the informant with a view to harass the petitioner, the petitioner has falsely been implicated in the present case.

Learned A.P.P. for the State has opposed the prayer for

Considering the facts and circumstances of this case, wherein both the parties are co-villagers and it is the submission of learned counsel for the petitioner that they had a quarrel when the she-buffalo of the informant had gone in the crop area of the petitioner because of this the present FIR has been lodged but there is no allegation of causing any injury to the informant and the other allegations are in the nature of superimposition, considering the submission this Court directs that in the event of his arrest or surrender within a period of four weeks from today, let the petitioner above named be enlarged on bail on furnishing bail bonds of Rs. 15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- Ist, Supaul in connection with Jadiya P.S. Case No. 136 of 2019, subject to the condition as laid down under Section 438

(2) of the Cr.P.C. i.e.

(i) a condition that the person shall make himself available for interrogation by a police officer as and when required;

(ii) a condition that the person shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade
