In this case, the petitioner is seeking anticipatory bail in connection with Mahila P.S. Case No.23 of 2018, registered for the offence punishable under Sections 376, 420, 323, 120(B) of the Indian Penal Code.

As per the allegation made in the written complaint filed in the police station that by allurement the petitioner has established sexual relationship with the complainant. It appears from the complaint that the present case is consensual sexual relationship.

Looking to the entire facts and circumstances of the case, let the petitioner, above-named, be released on anticipatory

Patna High Court Cr.Misc. No.80789 of 2018(2) dt.25-01-2019 2/2 bail in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Mahila P.S. Case No. 23 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
