The petitioner seeks bail in Amnour P. S. Case No. 112 of 2019 instituted for the offence under Section(s) 392 of the Indian Penal Code.

While the petitioner was in custody in other cases since 17.05.2019, he has been remanded in the instant case on 29.03.2019.

The First Information report is at the instance of delivery boy alleging that two unknown persons at gun point had snatched some money, motorcycle and his mobile phone. It is submitted by the petitioner's counsel that the petitioner has falsely been implicated in the instant case. There is no recovery of any of the articles alleged to have been

Patna High Court CR. MISC. No.83539 of 2019(4) dt.18-03-2020 2/2 snatched. The petitioner is in custody since 23.09.2019 and it is a case of implication merely based on suspicion. Till date the petitioner has also not been put on Test Identification Parade. The learned APP for the State opposed the prayer for bail. Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM- II, Dist. Saran, in connection with Amnour P. S. Case No. 112 of 2019, subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled.
