1. Heard the parties.

2. The petitioner apprehends her arrest in connection with Nokha P.S. Case No. 361 of 2025 dated 10.10.2025 registered under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2022.

3. As per the first information report the Police party recovered 05 liters of country made Mahua liquor from a room just near the shop of the co-accused Rajkishore Kumar Singh and 2.5 liters of Mahua liquor has been recovered from the house of the co-accused Golden Kumar. The Police party apprehended both the aforesaid co-accused persons.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case inasmuch as she has not committed any offence in the manner alleged. The name of the petitioner has transpired in this case on the basis of disclosure made by the arrested co-accused Rajkishore Kumar Singh and Golden Kumar. The illicit Mahua liquor has not been recovered from the conscious possession and / or premises belonging to the petitioner. The petitioner is a lady having no criminal antecedent.

Regard being had to the submission made by the parties, taking into consideration the the fact that name of petitioner has transpired in the disclosure made by the arrested co-accused, no illicit liquor has been recovered from the conscious possession and / or premises belonging to the petitioner and the petitioner is a lady having no criminal antecedent, accordingly , I am inclined to grant anticipatory bail to the petitioner.

6. Let the petitioner be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Excise-II, Sasaram, Rohtas in connection with Nokha P.S. Case No. 361
