2. The petitioner seeks regular bail in connection with Jalalpur P.S. Case No. 110/2023, lodged on 21.05.2023 under Section 302 of the Indian Penal Code and 27 of the Arms Act.

3. As per the prosecution case, the FIR has been lodged against the sole petitioner alleging therein that he resorted fire on the elder brother of the informant. Thereafter, the brother of the informant was taken to hospital where he has been declared dead by the doctor.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. In fact, the informant and his brother both were gone to participate the marriage of the nephew of the petitioner and in the marriage

Patna High Court CR. MISC. No.7389 of 2024(2) dt.17-02-2024 2/2 ceremony during harsh firing, this incident took place. The petitioner is in custody since 23.10.2023 having no criminal antecedent. The chargesheet has already been filed.

5. Learned counsel for the State opposes the prayer for bail and submits that there is directed allegation against the petitioner in the FIR.

6. Considering the nature of allegation levelled against the petitioner, I am not inclined to grant regular bail to the petitioner.

7. Accordingly, the prayer for regular bail of the petitioner in connection with Jalalpur P.S. Case No. 110/2023, pending before the learned ACJM-13, Saran at Chapra is hereby rejected.

8. With this observation, the bail application stands disposed off.
