The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 420, 120B and 465 of the Indian Penal Code.

Allegation as per complaint petition is that complainant has taken Rs. 5,000/- from the petitioner and in lieu of that he has given the land as a security by executing a deed of Rahan but after some time, when the complainant went to return the money, he came to know that instead of deed of rahan, the sale deed was got executed by the petitioner, fraudulently. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged in the complaint case. The petitioner is a very old deed writer and he prepared the sale deed upon the instruction of the

Patna High Court CR. MISC. No.674 of 2020(3) dt.24-02-2020 2/2 complainant and the main accused persons and complainant had also accepted the execution of sale deed before the SubRegistrar, Danapur. There is no specific allegation against the petitioner and the petitioner has got no criminal antecedent. The co-accused Shivnath Singh has been granted anticipatory bail by the Co-ordinate Bench of this Court vide order dated 01.08.2019 passed in Cr. Misc. No. 32725 of 2019.

In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-VI, Danapur in connection with Complaint Case No. 716 (c) of 2001, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
