The petitioner is accused in connection with Kotwali P.S. Case No. 435 of 2019, registered under Sections 399, 402 and 414 of the Indian Penal Code and Sections 25(1b)a/26/35 of the Arms Act. The accusation is that on receiving secret information about gathering of miscreants for making preparation to commit dacoity near Chandrashekhar Janta College, Gaya, the informant along with other police personnel reached there and surrounded the area and caught hold four persons namely, Bacha Yadav, Rahul Kumar, Subham Yadav (petitioner) and Pawan Kumar. On search, Bacha Yadav and

Patna High Court CR. MISC. No.80629 of 2019(2) dt.09-01-2020 2/2 Rahul Kumar were found in possession of country made pistol whereas this petitioner was found in possession of two stolen mobile sets and Pawan Kuamr was also found in possession of one stolen mobile set.

Learned counsel for the petitioner submits that, in fact, petitioner has falsely been implicated in the present case showing the recovery of two stolen mobile sets, in fact, both mobile sets are belonging to the petitioner but at the time of raid, petitioner could not produce paper regarding the said mobile sets. It is further submitted that petitioner is in custody since 16.09.2019.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya, in connection with Kotwali P.S.
