JUSTICE SANJAY PRIYA ORAL ORDER 20-06-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends her arrest in Mushahari P.S. Case No. 174 of 2017 instituted for the offence under Section 406 of the Indian Penal Code.

It is alleged in the written report that the Informant is Secretary of Puja Jivika Gram Sangathan. The petitioner was Treasurer of that Sangathan. The petitioner has defalcated an amount of Rs.4,80,079/- of the said Sangathan. It is further alleged that petitioner did not give any reply about misappropriated amount. She did not return the money also. Case diary has been received.

Learned A.P.P. after perusing the case diary has submitted that misappropriation has been detected during audit

Patna High Court Cr.Misc. No.24971 of 2018 (4) dt.20-06-2018 2/2 done by the Auditor which finds mention in the case diary. The petitioner was Treasurer of the aforesaid Sangathan. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail.
