2. Permission is accorded.

3 . This bail petition of petitioner No. 1 is dismissed as withdrawn .

4. Heard learned counsel for the petitioner No. 2 and the State .

5 . Petitioner apprehends arrest in a case registered for the offence punishable under sections 302 and 34 of the Indian Penal Code .

6. As per the prosecution case , daughter of informant was married with co-accused Prithwi Lal Sardar 17

Patna High Court CR. MISC. No.90111 of 2024(2) dt.05-02-2025 2/3 years ago and out of wedlock two children were born namely Aanchal Kumari aged About 12 years and Anand Kumar aged about 10 years. It is further alleged that on 29.05.2024 granddaughter of informant namely Aanchal Kumari informed through phone that all the accused persons including this petitioner forcibly administered poison to the daughter of informant namely Basanti Devi and upon the aforesaid information informant went to her daughter's house where informant found her daughter Basanti Devi lying in her courtyard in serious condition and during course of treatment she died.

7. Learned counsel for the petitioner submits that petitioner is agnate of the husband of the deceased. He is separate in mess and property . He is simple a victim of over implications. Petitioner has got no concern with the affairs of the couple or with the family members of the deceased. Petitioner claims clean antecedent.

8 . Learned counsel for the State opposes the bail petition of the petitioner.

9. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioner No. 2 as named above, be

No.90111 of 2024(2) dt.05-02-2025 3/3 enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM 1st Class Madhepura in connection with Shankarpur P.S. case No. 94 of 2024 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
