The petitioner apprehends his arrest in connection with Saraiya P.S. Case No. 543 of 2019 for the offence punishable under Sections 395, 397 and 307 of the Indian Penal Code and section 27 of the Arms Act.

The allegation is regarding the accused persons having tried to rob the informant, however, upon alarm being raised, the villagers had come there and had succeeded in apprehending one of the accused persons, who upon interrogation by the police, disclosed the complicity of the petitioner herein and others in the alleged incident. The learned counsel for the petitioner submit that the petitioner has been falsely implicated in the present case and he

Patna High Court CR. MISC. No.81008 of 2019(2) dt.10-12-2019 2/2 is having clean antecedent. It is further submitted that this Court has granted anticipatory bail to a similarly situated co-accused person vide order dated 25.11.2019 passed in Cr. Misc. No. 75052 of 2019.

Having regard to the facts and circumstances of the case, in the event of arrest or surrender in the court below within a period of four weeks from today, the petitioners above named are directed to be released on anticipatory bail on furnishing bail- bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 1st (West), Muzaffarpur in connection with Saraiya P.S. Case No. 543 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
