JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 The petitioner seeks regular bail in connection with Mojahidpur P.S. Case No. 255 of 2017, registered for offences punishable under Sections 341, 323, 307, 504, 506 and 34 of the Indian Penal Code.

Allegation against the petitioner is that he fired on the informant, however, the said firing did not hit him and coaccused assaulted him by means of brick on his head due to which, he sustained injury. Apart from that it appears that petitioner is an accused in fifteen other cases. It has been submitted on behalf of the petitioner that he has falsely been made accused in this case and although it is alleged that he fired on the informant, however, the said firing did not hit the informant. Further submission is that though he

Patna High Court Cr.Misc. No.65326 of 2018(4) dt.20-12-2018 2/2 is an accused in fifteen other cases but in all those cases, he is on bail and in this case, he has been in judicial custody since 03.11.2017.

Having heard both sides, no doubt petitioner is an accused in several other cases but in the present case except the allegation of firing, which did not hit anybody, there is nothing against the petitioner, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge, Bhagalpur, in connection with Mojahidpur P.S. Case No. 255 of 2017, subject to the condition that one of the bailors of the petitioner shall be his close relative and further the petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
