JUSTICE SANJAY PRIYA ORAL ORDER 11-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Ganga Bridge P.S. Case No. 89 of 2018 instituted for the offence under Sections 414/34 of the Indian Penal Code and Section 30(a) of Excise Prohibition Act.
Counsel for the petitioner submits that petitioner has clean antecedent. He is in custody since 17.6.2018. From the seizure list it appears that articles have been recovered from semi constructed house of Nanda Rai near Ganga Bridge.
Allegation against the petitioner is that he was caught on the spot loading few articles from the aforesaid house in the pick up van. Petitioner is said to be owner of aforesaid pick-up

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Vaishali at Hajipur, in connection with Ganga Bridge P.S. Case No. 89 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
