The petitioner seeks bail in anticipation of his arrest in connection with Sonbersa P. S. Case No. 08 of 2012 dated 15.01.2012 instituted for the offences under Sections 406 and 420 of the Indian Penal Code and Section 40 of the Bihar Mines and Minerals Act, 1972. The petitioner is suspected to have been running a brick-kiln without making payments for the same and thereby causing revenue loss.
The learned counsel for the petitioner submits
Patna High Court CR. MISC. No.85792 of 2019(7) dt.06-10-2020 2/2 that the petitioner was about to open a new brick-kiln but in the meantime, a case was lodged. It took almost two years for construction of the kiln and the petitioner has already deposited an amount of Rs. 44,500/-. Regard being had to the nature of accusation against the petitioner, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sitamarhi in connection with Sonbersa P. S. Case No. 08 of 2012, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
