Petitioner, already in custody, seeks bail in Gopalpur PS Case No. 138 of 2017 registered under Section 307/34 of the IPC and Section 27 of the Arms Act.

Learned Counsel for the petitioner submits that there is no overt act alleged against the petitioner of assault rather he is said to be order giver.

Having considered the said facts and circumstances, the petitioner, namely, Ramanand Rai is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Gopalganj in connection with Gopalpur PS Case No. 138 of 2017.
