Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 307, 323, 324, 325, 326, 504, 147, 148, 149 of the Indian Penal Code and 27 of Arms Act.
During course of assault, the petitioner caused firearm injury to Poonam Devi at her hand. The allegation of commission of fatal injury by firearm is against another co-accused.
Submission of the learned counsel for the petitioner is that the petitioner is in custody since 24.07.2017. During course of occurrence, petitioner also sustained injury at the hands of the prosecution and there is
Patna High Court Cr.Misc. No.10695 of 2018 (2) dt.23-02-2018 counter case also. The investigation is already complete. Petitioner is ready to cooperate with the trial. Learned counsel for the informant opposed the prayer for bail on the ground that co-accused Nand Kishore Singh and Ram Sakal Singh, who were alleged to have caused injury with the butt of gun at the head of the injured, were refused bail by a Coordinate Bench of this Court in Cr.Misc.No. 58859 of 2017. Moreover, Poonam Devi is still under treatment.
Considering the background of the allegation which is land dispute as well as injury to both sides and also considering the specific allegation against the petitioner and period already undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Obra Police Station Case No.120 of 2017, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
