2. Learned counsel for the petitioner is permitted to make necessary correction in the bail cancellation application.

3. This application has been filed on behalf of the petitioner for cancellation of bail granted to the opposite party no. 03 vide order dated 19.10.2020 passed by Chief Judicial Magistrate, Sheikhpura in connection with Sheikhpura P.S. Case No. 398 of 2020 corresponding to G.R. No. 1114 of 2020 registered for the offence under Sections 419, 420, 467, 468 and 471 of the Indian Penal Code.

4. It has been submitted by the learned counsel for the petitioner that the petitioner has also moved before the Court of 1st Additional District and Sessions Judge, Sheikhpura vide Cr. Misc. No. 17 of 2021 for cancellation of bail granted to the opposite party no. 03 but the same has been dismissed vide order dated 31.07.2023 saying that the petitioner has no locus.

5. After perusal of the records of the case, this court is of the view that the petitioner has locus for filing bail cancellation application.

6. In view of the above, this application is disposed of with liberty to the petitioner to approach the Principal District and Sessions Judge, Sheikhpura for cancellation of bail granted to the opposite party no. 03 and if such an application is filed then the same shall be considered and decided by the Principal District and Sessions Judge, Sheikhpura himself within three months of its filing.
